HISTORY: Though we tend to think of pirates today as renegades and outlaws terrorizing ships at sea (think Somalia), many early pirates of the 16th century were more like paid mercenaries, hired by European governments to harry the ships and interrupt the trade of enemy countries. These hired pirates, called privateers, operated under "letters of marque", which were, essentially, letters bearing the king's (or queen's) seal, giving the privateers permission to steal whatever they could from the ships of other countries, as long as they split the take with the crown that employed them.
Kings and queens were always looking for revenue to finance wars and other endeavors, and this "legalized piracy" was an important source of revenue for England and other countries. The British vice admiral and privateer, Sir Francis Drake, operated under such an arrangement with Queen Elizabeth in the 16th century, making life miserable for Spanish sea captains hauling treasure from the New World back to Spain. Innocence or guilt was mainly a point of view. He was a hero in England who was knighted by the queen, but the Spanish put a huge price on his head and would have cheerfully separated it from his shoulders if they had caught him.
The letters of marque protected the pirates from prosecution in the country that hired them, but they were certainly subject to be strung up from "the highest yardarm" if they were captured by one of the other countries whose ships they plundered .
